These Terms of Service (“Terms”) govern the relationship between you and THUNDER GAMES Co., Ltd., a company incorporated in the Republic of Korea (“THUNDER GAMES”, “Company”, “we”, “us”, or “our”), regarding your access to and use of our games, websites, customer support, communities, and related services (collectively, the “Service”).

Your use of the Service is also subject to our Privacy Policy and any other policies or rules that we publish for the Service from time to time. Those policies are incorporated into these Terms by reference.

Before accessing or using the Service, including installing or playing any THUNDER GAMES game, browsing any THUNDER GAMES website, or contacting customer support, you must read and agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you must not install, access, or use the Service.

If you access the Service through a third-party platform, app store, social network, login service, or device platform, including Apple, Google, Facebook, or any similar service, you must also comply with that third party’s applicable terms and policies. For purchases made through an app store or platform, the payment, cancellation, and refund procedures of that platform may also apply.

License

1.1. Limited License

Subject to your agreement to and continued compliance with these Terms, THUNDER GAMES grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your own personal, non-commercial entertainment purposes.

You may not use the Service for any purpose not expressly permitted by these Terms.

1.2. Age and Minors

You may not create an account or use the Service if you are under the age of 13.

If you are under the age of legal majority in your country or region, you may use the Service only with the consent of your parent or legal guardian. Your parent or legal guardian is responsible for your use of the Service, including any purchases made through your account.

If we become aware that a user is under the required age or is using the Service without required parental or guardian consent, we may restrict, suspend, or terminate that user’s access to the Service, subject to applicable law.

1.3. Account and Login Information

You may be required to create an account or use a third-party login service to access certain parts of the Service. You are responsible for keeping your account and login information secure.

You must not share, sell, rent, transfer, or allow any other person to use your account, except where expressly permitted by the Service.

You are responsible for all activity that occurs through your account, except where such activity is caused by our fault, a security incident attributable to us, or another reason for which you are not responsible under applicable law.

If you become aware of unauthorized access to your account, you should promptly contact our customer support at help@thundergames.co.kr.

We may remove, change, or reclaim usernames, nicknames, guild names, or other identifiers if they violate these Terms, infringe third-party rights, mislead other users, or are otherwise inappropriate for the Service.

Unless the Service expressly provides otherwise, each user may maintain only the number of accounts permitted by the technical design or rules of the applicable game.

1.4. License Restrictions

You agree that you will not, and will not attempt to:

a. use the Service for any commercial purpose without our prior written consent;

b. sell, rent, transfer, trade, lend, or give away your account, virtual currency, virtual items, rankings, game progress, or any other part of the Service, except where expressly permitted by the Service;

c. create an account using false information or on behalf of another person without authorization;

d. use cheats, exploits, bots, automation software, hacks, mods, unauthorized third-party software, or any tool designed to modify or interfere with the Service;

e. modify, reverse engineer, decompile, disassemble, decipher, or attempt to derive the source code or underlying structure of the Service, except to the extent such restriction is prohibited by applicable law;

f. interfere with, disrupt, overburden, or damage the Service, servers, networks, security systems, or other users’ ability to use the Service;

g. take advantage of bugs, errors, unintended game mechanics, payment errors, ranking errors, or other defects to gain an unfair advantage;

h. manipulate rankings, matchmaking, rewards, events, referrals, advertising rewards, or other systems;

i. attempt to gain unauthorized access to the Service, another user’s account, our servers, or any related system;

j. post, transmit, or make available any content that is unlawful, abusive, threatening, obscene, defamatory, discriminatory, sexually explicit, excessively violent, hateful, or otherwise inappropriate;

k. harass, abuse, threaten, impersonate, or harm another person, including other users, our employees, partners, or customer support representatives;

l. upload or transmit viruses, malware, spyware, or any other harmful code;

m. infringe or violate any copyright, trademark, patent, trade secret, privacy right, publicity right, or other right of any person or entity;

n. collect, disclose, or misuse personal information of other users;

o. solicit passwords, login information, payment information, or personal information from other users;

p. use the Service to send spam, chain letters, misleading messages, advertisements, or unauthorized promotional materials;

q. engage in any conduct that is illegal, harmful to the Service, unfair to other users, or contrary to the intended operation of the Service.

We may determine, acting reasonably and in good faith, whether conduct violates these Terms or the intended operation of the Service.

1.5. Suspension and Termination

We may restrict, suspend, terminate, modify, or delete your access to the Service or your account if we reasonably determine that:

a. you have violated these Terms or applicable law;

b. your account has been used for illegal, fraudulent, abusive, or harmful activity;

c. your conduct creates security, operational, legal, or reputational risk to the Service, other users, or third parties;

d. your account infringes or repeatedly infringes third-party rights;

e. such action is required by law, regulation, court order, government request, app store policy, or platform policy.

Where reasonable and legally required, we will provide notice or an opportunity to explain before taking action. However, we may take immediate action without prior notice if necessary to protect the Service, prevent harm, preserve evidence, comply with law, prevent fraud, or address urgent security or operational issues.

If your account is suspended or terminated due to your violation of these Terms, you may lose access to your account, game progress, rankings, rewards, free items, paid items, and other content associated with your account, subject to applicable law and any refund rights you may have.

We may terminate or delete accounts that have been inactive for 180 days or more, where permitted by applicable law and after providing prior notice where required or reasonably feasible.

1.6. Discontinuation of the Service

The Service may change over time. We may modify, suspend, discontinue, or stop supporting all or part of the Service, including any game, feature, event, server, or content.

Where the change materially affects users, we will try to provide reasonable prior notice through the Service, our website, in-game notices, or other appropriate means, unless urgent changes are required for security, legal, operational, or technical reasons.

If the Service or a material part of it is discontinued, we will handle paid unused virtual items, refunds, and other user rights in accordance with applicable law, app store policies, and platform policies.

Ownership

2.1. Games and Service

All rights, title, and interest in and to the Service are owned by or licensed to THUNDER GAMES. This includes, without limitation, games, titles, software, source code, object code, characters, character names, stories, dialogue, text, artwork, animations, graphics, sounds, music, audio-visual effects, user interface, game mechanics, designs, databases, server software, client software, documentation, and all related intellectual property rights.

Except for the limited license expressly granted to you under these Terms, no rights are transferred to you.

2.2. Accounts

Your account is a limited access right to use the Service. You do not own the account itself, and you do not have any property interest in the account, usernames, game progress, rankings, virtual currency, virtual items, or other attributes associated with the account, except to the extent mandatory law provides otherwise.

2.3. Virtual Items

The Service may include virtual currency, virtual goods, in-game items, points, rewards, passes, subscriptions, or other digital content (collectively, “Virtual Items”).

Virtual Items are licensed to you for use within the Service only. Virtual Items have no cash value, are not real money, and may not be sold, transferred, exchanged, redeemed, or refunded except where expressly permitted by the Service, required by applicable law, or required by the applicable app store or platform policy.

We may manage, adjust, modify, balance, replace, restrict, or remove Virtual Items as part of operating and improving the Service. If such changes materially affect paid unused Virtual Items, we will handle them in accordance with applicable law and platform policies.

User Content

3.1. Definition of User Content

“User Content” means any content, information, communication, image, sound, text, nickname, chat message, profile information, guild information, post, feedback, or other material that you upload, transmit, submit, or make available through the Service.

3.2. Your Responsibility for User Content

You are responsible for your User Content. By submitting User Content, you represent and warrant that:

a. you have the rights necessary to submit and use the User Content;

b. the User Content does not violate applicable law, these Terms, or third-party rights;

c. the User Content does not contain malware, spyware, or harmful code;

d. the User Content is not misleading, unlawful, abusive, discriminatory, obscene, defamatory, or otherwise inappropriate for the Service.

You should not submit confidential information through public areas of the Service. Other users may see, copy, or use information that you choose to make public.

3.3. License to User Content

You retain any rights you may have in your User Content.

By submitting User Content through the Service, you grant THUNDER GAMES a non-exclusive, worldwide, royalty-free license to host, store, copy, reproduce, display, perform, transmit, adapt, modify, and use your User Content solely for the purposes of operating, providing, maintaining, protecting, improving, promoting, and supporting the Service.

This license continues for as long as reasonably necessary to operate the Service and handle legal, security, backup, dispute, or compliance matters. If you delete User Content or close your account, we will stop using the deleted User Content within a reasonable time, except where continued retention or use is necessary for legal, security, backup, dispute, or compliance purposes.

We do not claim ownership of your User Content.

To the extent permitted by law, you agree not to assert moral rights or similar rights in a way that prevents us from operating, displaying, modifying, or adapting User Content as reasonably necessary for the Service. This does not limit any rights that cannot be waived under applicable law.

3.4. Monitoring and Moderation

We are not obligated to pre-screen all User Content. However, we may review, monitor, record, remove, restrict, edit, or disable access to User Content if we reasonably determine that it violates these Terms, applicable law, third-party rights, platform policies, or the intended operation of the Service.

We may monitor or record in-game chat, support communications, gameplay-related data, and other interactions for purposes such as customer support, fraud prevention, abuse prevention, security, service operation, and compliance with law, as described in our Privacy Policy.

3.5. User Interactions

You are responsible for your interactions with other users. We may, but are not obligated to, become involved in disputes between users.

If we investigate suspected unlawful, fraudulent, abusive, or improper activity, you agree to reasonably cooperate with us. We will not ask you to disclose your password. You should never provide your password to us or to any other person.

Fees and Purchase Terms

4.1. Purchases

The Service may allow you to purchase Virtual Items or other digital content with real money. Purchases may be processed by app stores, payment providers, platform operators, or other authorized partners.

You may purchase Virtual Items only through the official purchase methods provided in the Service or by our authorized partners. Any purchase, sale, transfer, or exchange outside the official Service is prohibited and may result in account restriction or termination.

4.2. Payment

You are responsible for all charges and applicable taxes incurred through your account, except where such charges result from our fault, unauthorized activity not attributable to you, or other circumstances for which you are not responsible under applicable law.

Prices and availability of products may change from time to time. We may correct pricing errors, product errors, or technical errors where permitted by law.

4.3. Refunds and Cancellation

Refunds, cancellations, and withdrawal of purchases are handled in accordance with applicable law, app store policies, platform policies, and the specific purchase conditions displayed at the time of purchase.

Where required by applicable law, you may have the right to cancel a purchase within the legally prescribed period. However, cancellation or refund may be restricted for digital content or Virtual Items that have been used, consumed, delivered immediately with your consent, or are otherwise not eligible for cancellation under applicable law, provided that the restriction is clearly disclosed where required.

If a purchase was made through Apple App Store, Google Play, or another platform, you may need to request a refund directly through that platform. We may assist with verification where reasonably possible, but the platform may control the refund process.

If a refund is granted, we may remove or adjust the relevant Virtual Items, benefits, game progress, or other content related to the refunded purchase.

Free items, promotional items, event rewards, compensation rewards, and items obtained without payment are generally not refundable or exchangeable for cash.

4.4. Subscriptions

If the Service offers subscriptions, the subscription terms, renewal conditions, cancellation method, billing period, and price will be provided at the time of purchase.

Subscriptions purchased through an app store or platform are managed by that app store or platform. You are responsible for cancelling a subscription through the applicable app store or platform before renewal if you do not want it to renew.

Updates to the Service

The Service may require updates, patches, or additional downloads. You may need to install updates to continue using the Service.

We may update, modify, rebalance, add, remove, or change content, features, events, systems, rules, rewards, characters, items, and other parts of the Service for purposes such as improving gameplay, correcting errors, maintaining fairness, enhancing security, complying with law, or operating the Service.

Where a change materially affects users, we will provide notice where required by applicable law.

Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis, to the maximum extent permitted by applicable law.

We do not guarantee that the Service will always be available, uninterrupted, error-free, secure, compatible with all devices, or free of harmful components. We do not guarantee that defects or errors will always be corrected.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the maximum extent permitted by law.

Nothing in these Terms limits any rights you may have under mandatory consumer protection laws.

Limitation of Liability and Indemnification

7.1. Limitation of Liability

To the maximum extent permitted by applicable law, THUNDER GAMES will not be liable for indirect, incidental, consequential, special, punitive, or similar damages, including loss of profits, loss of data, loss of business, service interruption, or other intangible losses arising out of or related to the Service or these Terms.

To the maximum extent permitted by applicable law, our total liability to you for any claim arising out of or related to the Service or these Terms will not exceed the amount you paid to THUNDER GAMES through the Service during the six months immediately before the event giving rise to the claim.

The limitations above do not apply to liability that cannot be limited or excluded under applicable law, including liability arising from our willful misconduct, gross negligence, fraud, death or personal injury caused by negligence, or statutory rights that cannot be waived.

7.2. Indemnification

You agree to indemnify and hold harmless THUNDER GAMES, its officers, directors, employees, agents, affiliates, and partners from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from:

a. your intentional or negligent violation of these Terms;

b. your unlawful use of the Service;

c. your infringement of third-party rights;

d. your User Content.

This indemnification obligation does not apply to claims, damages, or losses not attributable to your intentional or negligent act or omission.

Dispute Resolution and Governing Law

If a dispute arises between you and THUNDER GAMES, we encourage you to first contact us through customer support at help@thundergames.co.kr so that we can try to resolve the issue.

These Terms are governed by the laws of the Republic of Korea, without regard to conflict of law principles, except where mandatory consumer protection laws of your country or region provide otherwise.

The competent court for disputes arising from or related to these Terms or the Service will be determined in accordance with applicable law. Nothing in these Terms deprives you of any mandatory right to bring a claim in a court or forum available under applicable consumer protection laws.

Changes to These Terms

We may change these Terms from time to time.

If we make material changes, we will provide notice through the Service, our website, in-game notice, email, or other reasonable means before the changes take effect, where required by applicable law.

If you continue to use the Service after the effective date of the revised Terms, you will be deemed to have accepted the revised Terms, except where separate consent is required by applicable law.

If you do not agree to the revised Terms, you must stop using the Service.

Severability

If any part of these Terms is found to be invalid, illegal, or unenforceable, that part will be enforced to the maximum extent permitted by law or modified to achieve the intended effect as closely as possible. The remaining parts of these Terms will remain in full force and effect.

General Provisions

11.1. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign or transfer these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, transfer of business, or similar transaction, provided that such assignment does not materially reduce your mandatory legal rights. Where required by law, we will provide notice of such assignment.

11.2. Supplemental Policies

We may publish additional rules, event terms, community guidelines, contest rules, subscription terms, or other supplemental policies for specific parts of the Service. If there is a conflict between these Terms and supplemental terms, the supplemental terms will apply only to the specific feature, event, or service to which they relate.

11.3. Entire Agreement

These Terms, together with the Privacy Policy and any supplemental policies incorporated by reference, constitute the entire agreement between you and THUNDER GAMES regarding the Service.

11.4. No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be made in writing to be effective.

11.5. Notices

We may provide notices to you through the Service, in-game notices, website postings, email, app store notices, or other reasonable communication methods.

11.6. Equitable Remedies

You acknowledge that violations involving intellectual property, security, cheating, unauthorized access, or misuse of the Service may cause harm that cannot be fully remedied by monetary damages. We may seek injunctive or other equitable relief where permitted by applicable law.

Nothing in these Terms limits your mandatory legal rights or remedies.

11.7. Force Majeure

We will not be liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, war, terrorism, riots, labor disputes, power failures, network failures, server failures, cyberattacks, government actions, changes in law, app store or platform actions, epidemics, pandemics, or failures of third-party service providers, provided that we take reasonable steps where appropriate to minimize the impact on the Service.
